MyQRMed Platform Terms of Use

These Platform Terms of Use apply to the MyQRMed account platform, QR profile system, product activation system, mobile app if available, and related online services operated by MYQRMED PTY LTD.
These Terms apply when you create an account, activate or link a MyQRMed product, create or manage a MyQRMed profile, access the MyQRMed platform, or scan/access a MyQRMed QR profile.
By using the MyQRMed platform, you agree to these Terms.
These Terms should be read together with our:
If you do not agree to these Terms, you should not use the MyQRMed platform.
1. About MyQRMed
MyQRMed allows users to create, manage and share a user-controlled medical ID profile through a MyQRMed account and linked QR-enabled product.
A MyQRMed profile may be used to help communicate user-provided information in health, care, support and emergency situations.
MyQRMed is a communication tool. It is not a healthcare provider, clinical record provider, emergency service, emergency dispatch service, medical monitoring service or substitute for professional medical advice.
2. Storefront and platform
MyQRMed operates through:
- a website and online store; and
- a separate account/profile platform.
The online store is used for product browsing, product orders, delivery, invoices, NDIS/provider-funded ordering and related customer support.
The account/profile platform is used for account access, QR product activation, profile creation, profile updates and QR-accessible profile display.
Purchases are governed by the Website Terms of Sale. Use of the account/profile platform is governed by these Platform Terms of Use.
3. Online medical profile platform access included — no required subscription fee
Each eligible MyQRMed product includes access to the MyQRMed online medical profile service for a minimum period of 12 months from the date the order is delivered, or from the date the product is first activated, whichever occurs first.
The MyQRMed online medical profile service allows a user or authorised profile manager to create, update and make selected profile information available through a MyQRMed QR code, product ID, device code or profile link.
Where delivery cannot be reasonably confirmed, MyQRMed may use a reasonable delivery estimate based on dispatch records, tracking information, postage method, customer communications and other relevant information.
Delayed activation does not extend, restart or renew the minimum access period unless MyQRMed expressly agrees in writing.
MyQRMed currently provides ongoing access to the online medical profile service at no additional charge after the minimum access period while the service continues to be operated and made available by MYQRMED PTY LTD.
In this context, access to the online medical profile service, including any reference to lifetime access, means access for the service life of the MyQRMed online medical profile service while it continues to be operated and made available by MYQRMED PTY LTD, subject to these Terms.
It does not mean access is guaranteed for the lifetime of the customer or user, or for the physical lifetime of the product, QR code, bracelet, necklace, accessory or device.
MyQRMed may offer optional paid features, replacement products, accessories or additional services in the future. We will not charge you for optional paid features unless you agree to the charge.
Nothing in this clause limits any rights you may have under the Australian Consumer Law.
4. No medical advice or emergency service
MyQRMed does not provide medical advice, diagnosis, treatment, monitoring, clinical review, medication advice, emergency dispatch or emergency response.
Information stored in a MyQRMed profile is entered and managed by the user, parent, guardian, carer, nominee, authorised representative or responsible adult.
Healthcare providers, emergency responders, carers, support workers, family members, bystanders and others should use their own judgment and seek professional medical assistance where required.
MyQRMed is not a substitute for calling 000 in an emergency.
5. Accounts
You must provide accurate information reasonably required for account access, product activation, support, delivery, billing or identity verification.
You are responsible for keeping your login details secure and for activity that occurs under your account.
You must notify us promptly if you believe your account has been accessed without authorisation.
We may require verification or further information before providing account support, changing account access, linking or unlinking a product, deleting a profile, or disclosing information about an account.
MyQRMed profiles are user-managed. You control what medical, health, care and emergency information you choose to add, update, display or remove.
You are not required to include every medical condition, medication, dose, allergy, doctor, emergency contact or care note. However, any information you choose to include should be accurate, not misleading, and kept up to date where it may be relied on by others.
6. Profiles for children, dependants and supported persons
MyQRMed may be used by a parent, guardian, nominee, authorised representative, carer, provider, support worker or responsible adult only where that person has the required authority, consent or lawful basis to create, access or manage the profile.
This may include a child, dependant, NDIS participant under 18, aged-care client, home-care client, person with disability or person requiring support.
If you create or manage a profile for another person, you confirm that:
- you have the authority, consent or lawful basis required to provide and manage that person's information;
- you have authority to make selected information available through a MyQRMed QR code, product ID or profile link;
- the information you enter is accurate to the best of your knowledge;
- you will update the information when important details change;
- you will not misuse the person's information or profile.
Children should not create or manage a MyQRMed account without the involvement and consent of a parent, guardian or responsible adult.
If we become aware of a dispute about authority to manage a profile, we may suspend or restrict access to the profile while the issue is reviewed.
7. User responsibility for profile information
You are responsible for the accuracy, relevance and currency of information entered into a MyQRMed profile.
This includes medical conditions, medications, allergies, emergency contacts, doctors, providers, carers, support workers, care team details, care notes, profile photos and any other information you choose to provide.
You should update the profile whenever important information changes.
MyQRMed may display a "last updated" date to assist people viewing the profile.
MyQRMed does not independently verify the accuracy, completeness or currency of information entered into a profile.
8. QR code and profile access
A MyQRMed product may contain a QR code, product ID, device code, profile link or access code.
A person who scans or accesses a MyQRMed QR code, product ID or profile link may be able to view selected profile information.
This may include an emergency responder, healthcare provider, carer, support worker, family member, bystander or another person assisting the user.
MyQRMed cannot guarantee or verify the identity, role, motive, location or qualifications of every person who scans or accesses a QR code, product ID or profile link.
You should only include information in the QR-accessible profile that you are comfortable being accessed in this way.
Once information has been displayed through a QR scan, product ID or profile link, MyQRMed cannot control whether the person who accessed it remembers, records, copies, photographs, screenshots, shares or otherwise uses that information outside the MyQRMed platform.
9. Privacy or access notice before profile view
MyQRMed may display a privacy, warning or access notice before a profile is shown.
This notice is designed to remind viewers that the profile may contain personal and health information and should only be accessed for genuine health, care, support, emergency or authorised purposes.
This notice is intended to reduce privacy risk, but it cannot remove all risk of unauthorised, unnecessary or unintended access.
10. Viewers of QR profiles
If you scan, open or access a MyQRMed QR code, product ID or profile link, you agree that you will only access and use the information for a genuine health, care, support, emergency, authorised or lawful purpose.
You must not misuse, copy, publish, share, alter, exploit or disclose another person's MyQRMed profile information except where reasonably necessary for the genuine purpose for which it was accessed, or where required or permitted by law.
11. Consent and privacy
Use of MyQRMed involves personal information and may involve sensitive health information.
By creating or managing a MyQRMed profile and entering health information, you consent to MyQRMed collecting, holding, using and disclosing that information for the purposes described in our Privacy Policy and these Terms.
If you are creating or managing a profile for another person, you confirm that you have the authority, consent or lawful basis required to provide that person's information and to make selected information available through a MyQRMed QR code, product ID or profile link.
You may withdraw consent by deleting information from the profile, requesting account deletion, or contacting MyQRMed support. Withdrawal of consent may affect your ability to use some or all MyQRMed services.
Our handling of personal information is explained in our Privacy Policy.
12. Licence to operate the platform
You remain responsible for the information you enter into your MyQRMed profile.
You control what information you choose to add, update, display or remove from your profile.
You give MYQRMED PTY LTD permission to host, store, process, display, transmit, back up, secure and use that information only as reasonably necessary to:
- provide the MyQRMed platform;
- operate QR profile access;
- activate and link MyQRMed products;
- provide customer support;
- maintain and troubleshoot the platform;
- secure the platform;
- prevent misuse, fraud or unauthorised access;
- comply with legal obligations;
- protect legitimate business interests.
This permission does not give MyQRMed ownership of your profile information.
This permission ends when the information is deleted from active systems, subject to backup, legal, accounting, security, fraud-prevention, dispute-resolution and legitimate retention requirements.
13. Acceptable use
You must not use MyQRMed to:
- provide false, misleading, unlawful, abusive or harmful content;
- impersonate another person;
- create or manage a profile for another person without authority;
- access another person's profile without a genuine health, care, support, emergency, authorised or lawful reason;
- interfere with the platform's security or operation;
- upload malware or harmful code;
- reverse engineer, scrape, attack, overload or misuse the platform;
- attempt to discover, guess, enumerate or misuse QR/profile links, product IDs, device codes, access codes or security tokens;
- use automated tools to access, harvest, copy or test QR/profile links without written permission;
- breach another person's privacy, confidentiality or legal rights;
- use MyQRMed for unlawful, threatening, abusive, harassing, exploitative, fraudulent or harmful purposes.
14. Product activation and linking
Some MyQRMed products require activation or linking to a MyQRMed account before the QR/profile function operates.
You are responsible for activating your product correctly and entering the correct product ID, device code or other activation details.
If you believe a product ID, QR code, device code, engraving, print or linked profile is incorrect, mismatched, duplicated, damaged or not functioning as expected, you should contact MyQRMed support promptly.
MyQRMed may request photographs, product details, proof of purchase or other information to investigate and resolve the issue.
15. Security
We use reasonable technical and organisational safeguards designed to protect personal information.
However, no internet-based service, QR system, account system or online platform can be guaranteed to be completely secure.
You are responsible for:
- keeping your login details confidential;
- using strong and secure passwords;
- not sharing account access unless appropriate;
- logging out on shared devices;
- notifying us promptly if you suspect unauthorised access, misuse, lost login details, incorrect profile access or a QR/product issue that may affect privacy or safety.
We may take steps to protect accounts and profiles, including restricting access, resetting credentials, suspending features, investigating unusual activity or requiring verification.
16. Availability, maintenance and changes
We aim to keep the MyQRMed platform available and functional, but we do not guarantee uninterrupted, error-free or permanent access.
The platform may be unavailable, interrupted, delayed, modified or restricted due to:
- maintenance;
- updates;
- security measures;
- technical issues;
- internet or telecommunications issues;
- third-party service failures;
- hosting, software or infrastructure issues;
- legal or compliance requirements;
- misuse, fraud or security threats;
- events outside our reasonable control.
We may update, suspend, modify, replace or discontinue features where reasonably required for security, maintenance, compliance, technical, operational or business reasons.
17. Platform discontinuation or closure
MyQRMed currently intends to continue operating the MyQRMed profile platform while it remains commercially, technically and legally viable to do so.
Continued access after the minimum access period is governed by clause 3 and remains subject to the online medical profile platform continuing to be operated and made available by MYQRMED PTY LTD.
If MyQRMed decides to permanently discontinue the platform or materially reduce access, we will take reasonable steps to notify affected users where practicable.
Where practicable, we may provide a reasonable period for users to update, remove, copy or request deletion of profile information before permanent closure.
Nothing in this clause limits any rights you may have under the Australian Consumer Law.
18. Data storage, backups and logs
We may maintain backups, logs and records for security, continuity, troubleshooting, legal, accounting, fraud-prevention, dispute-resolution and business purposes.
We do not guarantee that we can restore a specific item of user content from a specific date or time unless we expressly agree in writing.
Deleted information may remain in backups or logs for a limited period before being overwritten or securely removed according to our retention processes.
19. Account deletion and profile removal
You may request deletion of your account or profile information.
Where you request deletion, we will delete or de-identify active profile information unless we are required or permitted to retain limited information for legal, security, accounting, tax, dispute-resolution, fraud-prevention, backup or legitimate business purposes.
If an account or profile is deleted, the associated QR-enabled product may no longer display profile information.
If a QR code, product ID or profile link has previously been shared, scanned, photographed, copied, indexed, saved or recorded by another person, MyQRMed cannot control information that has already been accessed or copied outside the MyQRMed platform.
20. Suspension or termination
We may suspend, restrict or terminate access where reasonably necessary, including where:
- you breach these Terms;
- we believe there is unauthorised access or misuse;
- the account creates security, legal, privacy or safety risk;
- the service is being misused;
- information appears false, misleading, harmful or unauthorised;
- there is a dispute about authority to manage a profile;
- a QR code, product ID or profile link appears mismatched, duplicated, compromised or incorrectly linked;
- we are required or permitted to do so by law.
Where reasonable and practicable, we may notify the account holder of suspension, restriction or termination.
21. Third-party services
The MyQRMed platform may rely on third-party services for hosting, communications, email, SMS, analytics, security, payment, invoicing, delivery, technical support or related business operations.
We are not responsible for interruptions, failures, delays or issues caused by third-party services outside our reasonable control, subject to your rights under the Australian Consumer Law.
22. Intellectual property
MYQRMED PTY LTD owns or licenses the MyQRMed name, branding, website, platform, software, design, layout, content and related intellectual property.
You must not copy, reproduce, modify, reverse engineer, exploit or use MyQRMed intellectual property except as permitted by these Terms or with our written consent.
You retain responsibility for the personal information and profile information you enter into the platform.
23. Feedback and suggestions
If you provide feedback, suggestions, ideas or improvement requests about MyQRMed, we may use them to improve our products and services without compensation to you.
This does not give MyQRMed ownership of your personal profile information or health information.
24. Consumer rights
Nothing in these Terms excludes, restricts or modifies any rights, remedies, guarantees or protections that you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.
Where MyQRMed supplies services to a consumer, those services may come with guarantees that cannot be excluded under the Australian Consumer Law.
If there is any inconsistency between these Terms and your non-excludable legal rights, your non-excludable legal rights prevail.
25. Limitation of liability
To the maximum extent permitted by law, MYQRMED PTY LTD is not liable for indirect, incidental, special, consequential or punitive loss arising from your use of the platform, QR/profile system, products or related services.
To the maximum extent permitted by law, MyQRMed is not liable for injury, illness, death, loss, damage or harm caused by:
- inaccurate, incomplete, outdated or misleading user-entered information;
- a user choosing not to enter certain information;
- failure by a person to scan, access, read, understand or rely on a MyQRMed product or profile;
- internet, device, browser, camera, telecommunications or third-party service issues;
- unauthorised access caused by failure to protect login details;
- information displayed, copied, saved, photographed, screenshotted or shared after a QR/profile link is accessed;
- use of MyQRMed as a substitute for professional medical advice, clinical assessment or emergency services.
Nothing in this clause limits any rights that cannot legally be limited.
26. Changes to these Terms
We may update these Terms from time to time.
The updated version will be posted on our website or platform with a new "last updated" date.
If we make significant changes, we will take reasonable steps to notify affected users.
Your continued use of the platform after updated Terms are published or notified will be taken as acceptance of the updated Terms, except where further consent is required by law.
27. Governing law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
