MyQRMed Website Terms of Sale

These Website Terms of Sale apply to purchases made through the MyQRMed website and online store operated by MYQRMED PTY LTD.
By placing an order through our website, submitting an order form, requesting an invoice, or approving a funded order, you agree to these Terms of Sale.
These Terms should be read together with our:
If you use the MyQRMed account platform, QR profile system or medical profile services, the separate Platform Terms of Use also apply.
1. About MyQRMed
MyQRMed supplies medical ID products, QR-enabled accessories and related services that allow a user to link a physical product to a MyQRMed online profile.
MyQRMed products are designed to help communicate user-provided information in health, care, support and emergency situations.
MyQRMed does not provide medical advice, diagnosis, treatment, monitoring, emergency dispatch or emergency response services.
MyQRMed is not a substitute for calling 000 in an emergency.
2. Storefront and platform
MyQRMed operates through:
- a website and online store; and
- a separate account/profile platform.
The website and online store are used for product browsing, product orders, checkout, invoices, NDIS/provider-funded ordering, delivery and related customer support.
The account/profile platform is used for account access, product activation, QR profile linking, medical profile creation, profile updates and QR-accessible profile display.
These Terms of Sale apply to the purchase of MyQRMed products and related order services.
Use of the MyQRMed account/profile platform is governed by the separate Platform Terms of Use and Privacy Policy.
3. Online medical profile platform access included — no required subscription fee
Each eligible MyQRMed product includes access to the MyQRMed online medical profile service for a minimum period of 12 months from the date the order is delivered, or from the date the product is first activated, whichever occurs first.
The MyQRMed online medical profile service allows a user or authorised profile manager to create, update and make selected profile information available through a MyQRMed QR code, product ID, device code or profile link.
Where delivery cannot be reasonably confirmed, MyQRMed may use a reasonable delivery estimate based on dispatch records, tracking information, postage method, customer communications and other relevant information.
Delayed activation does not extend, restart or renew the minimum access period unless MyQRMed expressly agrees in writing.
MyQRMed currently provides ongoing access to the online medical profile service at no additional charge after the minimum access period while the service continues to be operated and made available by MYQRMED PTY LTD.
In this context, access to the online medical profile service, including any reference to lifetime access, means access for the service life of the MyQRMed online medical profile service while it continues to be operated and made available by MYQRMED PTY LTD, subject to these Terms.
It does not mean access is guaranteed for the lifetime of the customer or user, or for the physical lifetime of the product, QR code, bracelet, necklace, accessory or device.
MyQRMed may offer optional paid features, replacement products, accessories or additional services in the future. We will not charge you for optional paid features unless you agree to the charge.
Nothing in this clause limits any rights you may have under the Australian Consumer Law.
4. Orders and customer information
When placing an order, you agree to provide accurate information reasonably required to process and supply your order, including your name, contact details, delivery address, product selection, customisation details, funding details if applicable, and any information required to process your order.
You are responsible for checking your order details before submitting the order.
If you provide incorrect, incomplete or outdated information, this may delay or prevent fulfilment of your order.
If you notice an error after placing an order, contact us promptly at support@myqrmed.com.au.
5. Orders for another person
If you place an order for another person, including a child, dependant, NDIS participant, aged-care client, home-care client or person you support, you confirm that you have authority or consent to do so.
You are responsible for ensuring the product is appropriate for the intended user.
If the order involves personal, health, NDIS, aged care, home care or support-related information about another person, you confirm that you have authority to provide that information to MyQRMed.
6. Order acceptance
Submitting an order does not automatically mean the order has been accepted.
MyQRMed may refuse, cancel or delay an order where reasonably necessary, including where:
- payment has not been received or approved;
- required information is missing or appears incorrect;
- the item is unavailable;
- there is an obvious pricing, product, website or system error;
- the order appears fraudulent, abusive, unauthorised or unlawful;
- the order cannot reasonably be fulfilled;
- the order creates a legal, privacy, safety, security or operational risk.
If we cancel an order after payment has been received, we will provide a refund of the amount paid for the cancelled item unless we are legally entitled to withhold payment.
7. Product descriptions and images
We aim to ensure that product descriptions, images, pricing and availability are accurate.
Product images are for illustration and general guidance. Minor differences may occur between product images and the product supplied, including colour, size, display appearance, packaging, layout, engraving position, QR placement or design details.
Product information is provided for general information only and is not medical advice.
8. Customised, engraved and QR-enabled products
Some MyQRMed products may be customised, engraved, printed, encoded, linked, activated or otherwise prepared specifically for an individual order.
You are responsible for checking any customisation details before submitting your order.
Customised or engraved products may not be suitable for resale or reuse.
Subject to your rights under the Australian Consumer Law, customised, engraved, worn, used or hygiene-sensitive items may not be eligible for change-of-mind returns.
If a customised, engraved or QR-enabled product is faulty, incorrect, mismatched, duplicated, not fit for purpose, or does not match the order or description, we will assess the issue under our Refund, Returns & Warranty Policy and the Australian Consumer Law.
9. QR codes, product IDs and profile linking
MyQRMed products may contain a QR code, product ID, device code, profile link or similar identifier.
Some products require activation or linking to a MyQRMed account before the QR/profile function operates.
You are responsible for activating your product correctly and keeping your MyQRMed profile accurate and up to date.
If you believe a QR code, product ID, device code, engraving, print or linked profile is incorrect, mismatched, duplicated, damaged or not functioning as expected, you should contact MyQRMed promptly and provide photographs, order details, product details or other information reasonably requested to investigate the issue.
10. Pricing and payment
Prices are displayed in Australian dollars unless otherwise stated.
Where required by law, consumer-facing prices will be displayed as the total price inclusive of GST and other mandatory charges, excluding optional charges such as delivery where these are calculated separately. Business, wholesale, provider-funded or invoice-based pricing may be displayed differently where permitted by law.
We may accept payment through online checkout, invoice, NDIS plan-managed processes, aged-care provider ordering, home-care provider ordering, wholesale approval or another approved payment method.
Where payment is made by invoice, the order may not be processed or dispatched until payment approval or payment receipt has been confirmed, unless MyQRMed agrees otherwise in writing.
We may correct obvious pricing, typographical, product, website or system errors before accepting or dispatching an order.
11. Promotions, discounts and offers
Promotions, discounts, coupon codes and special offers may be subject to additional conditions.
Unless stated otherwise, promotions cannot be combined, exchanged for cash, applied retrospectively, or used after expiry.
MyQRMed may vary or withdraw promotions where reasonably necessary, including where there has been an error, misuse, fraud or unauthorised use.
12. NDIS, aged care, home care and provider-funded orders
Where an order is submitted under NDIS, aged care, home care, CHSP, Support at Home, DVA, provider funding or similar arrangements, approval and payment are subject to the relevant participant, representative, plan manager, provider, funding body or authorised payer.
Submitting an order does not guarantee that funding will be approved.
The person submitting the order is responsible for ensuring that:
- they have authority to submit the order;
- the product is appropriate for the intended user;
- the relevant funding arrangement permits the purchase;
- all information provided is accurate;
- any required consent, authority or service agreement is properly obtained.
MyQRMed may request further information before processing a funded order.
Where funding approval or payment is refused, delayed or withdrawn, the order may be delayed, cancelled or require another approved payment method before dispatch.
13. Wholesale, provider and business orders
Wholesale, provider, business, pharmacy or reseller orders may be subject to separate written terms, account approval, minimum order quantities, payment terms, display conditions or supply arrangements.
If separate written terms are agreed, those terms will apply to the extent of any inconsistency with these Website Terms of Sale.
Nothing in these Terms excludes, restricts or modifies any non-excludable rights that may apply to eligible small-business customers under Australian law.
14. Shipping and delivery
We will use reasonable efforts to dispatch orders within the estimated timeframe shown on the website or communicated to you.
Delivery times are estimates only.
We are not responsible for delays caused by postal services, couriers, customs, incorrect addresses, payment delays, supplier delays, stock delays, events outside our reasonable control, or other circumstances we could not reasonably prevent.
You are responsible for providing a correct and complete delivery address.
If an order is returned to sender because of an incorrect address, failure to collect, refusal of delivery, or other issue not caused by MyQRMed, we may require payment of reasonable re-delivery costs before resending the order.
Nothing in this clause limits your rights under the Australian Consumer Law.
15. Delivery risk and lost parcels
Risk in a product passes to you when the product is delivered to the delivery address you provided, subject to your rights under the Australian Consumer Law.
If tracking shows an item has been delivered but you have not received it, you should contact us promptly so we can assist with reasonable enquiries.
If an item is lost in transit before delivery, we will assess the issue and provide an appropriate remedy where required by law.
16. Product activation and account support
Some MyQRMed products require activation, account creation or product linking before the QR/profile function operates.
If you require help activating a product, contact MyQRMed support.
MyQRMed may request proof of purchase, product details, photographs, account information or identity verification before assisting with activation, linking, unlinking or account-related support.
17. Product and platform limitations
You acknowledge that:
- a MyQRMed product depends on the product being worn, carried, visible or accessible;
- a QR code depends on a person choosing to scan or access it;
- internet, device, camera, browser, telecommunications or third-party service issues may affect access;
- MyQRMed cannot guarantee that a healthcare provider, emergency responder, carer, bystander or other person will scan the product, access the profile, understand the information or rely on it;
- MyQRMed does not independently verify medical or profile information entered by users;
- MyQRMed does not provide emergency monitoring, emergency dispatch or clinical review.
18. Returns, faults and warranty
Returns, faults and warranty claims are handled in accordance with our Refund, Returns & Warranty Policy.
Nothing in these Terms excludes, restricts or modifies any rights, remedies, guarantees or protections that you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.
Subject to your rights under the Australian Consumer Law, returns may be accepted where:
- the item is faulty;
- the wrong item was supplied;
- the item does not match the order;
- the item does not match the description;
- the item is not fit for a purpose made known to MyQRMed;
- another remedy is required by law.
We may require proof of purchase, photographs, return of the item, product details, account details or other information reasonably required to assess a return, fault or warranty claim.
Subject to your rights under the Australian Consumer Law, MyQRMed does not generally accept change-of-mind returns for customised, engraved, worn, used or hygiene-sensitive items.
19. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
If a product or service fails to meet a consumer guarantee, you may be entitled to a remedy such as repair, replacement, refund, cancellation or compensation depending on the circumstances.
Nothing in these Terms, our Refund, Returns & Warranty Policy, or any warranty statement is intended to limit, exclude or replace your rights under the Australian Consumer Law.
20. No medical advice or emergency service
MyQRMed products and services are designed to assist with communication of user-provided information.
They do not replace professional medical advice, clinical assessment, emergency services, medication advice, care planning, emergency dispatch, clinical monitoring or the judgment of healthcare professionals, carers or emergency responders.

21. Third-party services
MyQRMed may rely on third-party services for website operation, hosting, payments, communications, invoicing, delivery, analytics, security, support or related business operations.
We are not responsible for interruptions, failures, delays or issues caused by third-party services outside our reasonable control, subject to your rights under the Australian Consumer Law.
22. Privacy
MyQRMed handles personal information, and may handle sensitive health information, in accordance with our Privacy Policy.
If you provide information about another person, you confirm that you have authority, consent or a lawful basis to do so.
If you create or manage a MyQRMed profile, the Platform Terms of Use and Privacy Policy also apply.
23. Intellectual property
MYQRMED PTY LTD owns or licenses the MyQRMed name, branding, website, images, text, product descriptions, platform, design, layout, content and related intellectual property.
You must not copy, reproduce, modify, exploit or use MyQRMed intellectual property except as permitted by law or with our written consent.
24. Limitation of liability
To the maximum extent permitted by law, MYQRMED PTY LTD is not liable for indirect, incidental, special, consequential or punitive loss arising from your use of the website, products, QR/profile system, platform or related services.
To the maximum extent permitted by law, MyQRMed is not liable for injury, illness, death, loss, damage or harm caused by:
- inaccurate, incomplete, outdated or misleading user-entered information;
- a user choosing not to enter certain information;
- failure by a person to scan, access, read, understand or rely on a MyQRMed product or profile;
- internet, device, browser, camera, telecommunications or third-party service issues;
- unauthorised access caused by failure to protect account login details;
- information displayed, copied, saved, photographed, screenshotted or shared after a QR/profile link is accessed;
- use of MyQRMed as a substitute for professional medical advice, clinical assessment or emergency services.
Nothing in this clause excludes, restricts or modifies any rights, remedies, guarantees or protections that cannot legally be excluded, restricted or modified.
25. Events outside our reasonable control
MyQRMed is not responsible for delay or failure to perform an obligation where the delay or failure is caused by events outside our reasonable control.
This may include postal or courier disruptions, supplier delays, natural disasters, cyber incidents, power failures, internet or telecommunications failures, government actions, legal restrictions, industrial disputes, illness, platform outages or other events beyond our reasonable control.
Nothing in this clause limits your rights under the Australian Consumer Law.
26. Changes to these Terms
We may update these Terms from time to time.
The updated version will apply to orders placed after the updated Terms are posted on our website.
Changes to these Terms do not remove rights that already apply to completed purchases under the Australian Consumer Law.
27. Governing law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
